We like to keep things simple!
So, instead of pages and pages of 'legal speak' we (that is Gesko Limited which is the company that owns "My Farewell") set out how we deliver our services (which are described on our home page) and generally do business with you as follows:
We do business in a simple, ethical, straightforward and proportionate way and expect the people that we deal with as either customers or suppliers to work with us the same way, in a spirit of good faith and common sense.
We will make mistakes, everyone does. When we do, we will do our best to put them right as soon as we can.
We will not monitor, moderate or check what you leave us to send out for you when you die, but reserve the right to do so. It is your responsibility to make sure that what you send us is legal, honest and decent and that you have permission to use any material that you do not hold the relevant rights to. If it comes to our attention that there is or may be a problem with anything that you send us, or if we are unhappy publishing something that you send us, or if you submit more data than is reasonable we reserve the right to suspend all or part of your content and, if we feel that it is appropriate to delete your account completely. If we are aware that an offence has or may have been committed we will supply all relevant information to the appropriate authorities without reference to you.
We will also suspend your account if payment is late or recalled, but we will not do this if the reason that the payment has failed is because your bank account has been frozen on your death. In either event we reserve the right to delete your account if payment has not been made or if notification from your notifier has not been received within one month of the missed payment.
Following notification we will make your content available on our website for the period of at least two years.
We operate in a sensitive and delicate market and can only efficiently do so if there is good faith, common sense and goodwill between us. When we receive notification of your death from your notifier which matches the details held by us we will send out your MY FAREWELL messages. We will not either check to see that what we are being told is accurate or accept any notification from any other person. It is up to you therefore to make sure that you choose your notifier with care and to ensure that they know what to do when the time comes.
We will hold and use your personal data to deliver our service but (in the absence of your specific or implied consent) not further or otherwise except in an anonymised format for our own statistical and marketing purposes. Our full Privacy, Data and Cookie policies follow - please read them carefully. It may be necessary to change these terms and policies from time to time, but we'll tell you if we do.
Gesko Limited is incorporated in England and regulated by English law. If things go horribly wrong (which we hope they won't!!) any dispute will be dealt with in accordance with the Laws of England and Wales and be subject to the exclusive jurisdiction of the English courts.
